AGREEMENT
This Agreement is a legally binding contract ("Agreement") entered into by and between PKMISSION, an Indian company operating under the brand Magnett ("Company," "Magnett," "Us," or "We"), and any individual or entity accessing or utilizing the Magnett platform and its associated services ("User" or "You"). By accessing, registering, or using any of our Services, you signify your full and unconditional acceptance of and agreement to be bound by these Terms. If you do not agree to these Terms, you may not access, visit, or use the Services.
INTRODUCTION TO THE SERVICES
The Magnett platform comprises the website www.magnett.co.in ("Website") and the mobile application Magnett ("App"). These Terms govern all users, including browsers, content providers, customers, and contributors. Our Services are online portals that facilitate the creation of user profiles and enable participation in tasks, projects, and financial products for personal and professional development and compensation. This Agreement applies to the Website, the App, and any other services, such as our advertisements and "Apply with Magnett" plugins, that explicitly reference this document.
USER PROFILE AND REGISTRATION
While browsing our platform does not require registration, accessing the full range of Services necessitates the creation of a User Profile. To register, you must provide a valid email address, a contact number, and verify your identity via a One-Time Password (OTP). You are responsible for maintaining the confidentiality of your account information, ensuring its accuracy, and updating it promptly. You must register in your real name, avoid impersonation, and not transfer your account. Any unauthorized use of your account may result in liability for any losses incurred by Magnett or third parties.
ELIGIBILITY AND ACCOUNT MANAGEMENT
To use our Services, you must be at least the "Minimum Age" of 18 years old. Minors require parental consent. You agree to maintain a single Magnett account and to keep your password secure and confidential. You are solely responsible for all activity that occurs under your account. plugins, that explicitly reference this document.
TERMINATION OR SUSPENSION OF SERVICES
Magnett reserves the right to terminate, suspend, or restrict your access to your User account or any portion of the Services without prior notice, at our sole discretion, for any reason, including but not limited to a breach of this Agreement. We actively monitor for fraudulent accounts and may delete them immediately, with potential legal consequences for fraudulent activity.
USER OBLIGATIONS
You agree to use the Services in strict compliance with these Terms, all applicable laws, and all platform guidelines. Prohibited actions include, but are not limited to, fraudulent activities, using false aliases, and unauthorized access to our systems. Your continued use of the platform constitutes acceptance of this legally binding agreement.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Magnett, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or any transactions you conduct with third parties listed on Magnett.
COMPANY'S RIGHTS AND OBLIGATIONS
- Responsibility for Postings: Companies posting opportunities on the platform confirm they are authorized to do so and hold all necessary licenses and permits for recruitment. You shall indemnify Magnett against any claims arising from unauthorized postings.
- Use of Information: All information you provide and that Magnett displays on the platform becomes public. Magnett reserves the right to use your trademarks and publish internship vacancies on its platform, social media channels, and other media without liability.
- Genuineness of Opportunities: You confirm that all advertised opportunities are genuine and that you will not charge any fee to applicants. You are prohibited from using applicant data for purposes other than intern hiring without Magnett's express written consent.
- Accountability: You must provide accurate and complete details for your organization and the internship. Misinformation may lead to your account being permanently blocked. You must also respond to any student complaints brought to your attention within 7 days, or your posting may be suspended.
INTELLECTUAL PROPERTY RIGHTS
"IPR" refers to all copyrights, trademarks, patents, trade secrets, moral rights, and other intellectual property rights. All IPR in the name "Magnett," the platform, and its Services belong exclusively to Magnett. You are strictly prohibited from:
- Accessing non-public areas of our services.
- Using any automated means to access or search the Services without our written permission.
- Forging any TCP/IP packet header or email header information.
- Interfering with or disrupting the access of any user, host, or network.
LINKED SITES
Our platform may contain links to third-party websites and information ("Linked Sites"). We provide these links for convenience and do not endorse, nor are we responsible for, the content of any Linked Site. You access and use Linked Sites at your own risk. Magnett is not liable for any damages or losses incurred from your dealings with such third parties.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE OFFER NO GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOUR RELIANCE ON ANY CONTENT FROM THIS PLATFORM IS AT YOUR SOLE RISK.
MAGNETT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. WE ARE NOT LIABLE FOR ANY LOSS OF DATA, TECHNICAL ISSUES, OR ANY DAMAGES (DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY) ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY IS COMPREHENSIVE AND APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.
GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement and your use of the Services shall be governed by and construed in accordance with the laws of India. The exclusive jurisdiction for any disputes or legal proceedings arising under this Agreement shall be the courts located in Delhi. You waive any right to institute legal proceedings in any other jurisdiction.
MISCELLANEOUS
- Waiver: Any failure by us to exercise a right under these Terms does not constitute a waiver of that right.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Magnett regarding the Services, superseding all prior discussions and agreements.
- Notice: All notices under this Agreement will be sent via email to the address on file and are deemed received 12 hours after transmission.
REPORT ABUSE & GRIEVANCES
For any abuse or violation of these Terms or our Privacy Policy, please report it to info@magnett.co.in. For any other grievances or complaints, you may contact our Grievance Officer, Anita Gupta, at the same email address.
ACCESS OPT-OUT
You have the right to revoke your consent for our services. You can unsubscribe from marketing emails via the provided links or contact our support team at info@magnett.co.in to assist with account deactivation.
